A big win in the federal Office of the Umpire

The EI commission alleged that my client wasn’t available for work because her child didn’t have a spot in a child care when she was receiving her EI benefits. The commission demanded that the mother pay back over $15,000. The commission ignored the fact the mother had her own parents looking after the child and that she had a backup babysitter. The Board of Referees sided with the commission.

At that point, I was hired to argue an appeal to the Umpire. After a hearing a few weeks ago, we received the decision this week. The Umpire ruled that the Board made serious errors and sent the case back to a different panel for a new hearing. The Umpire agreed with my argument that the Board must take the mother’s complete evidence into account.

I recently set up a profile on AdviceScene, a lawyer-directory and legal-info website. Their model is to list lawyers in a directory and to encourage them to answer laypeople’s legal questions online. I also collaborate with AdviceScene on my blog contributions to Law is Cool.

How my computing world has changed

First, it was DOS, then Windows. Then Linux, then Mac. Hardware has always been getting better and better. Software has always been better first and worse later. Now as I am moving everything to the cloud, I care less and less about hardware and software. A tablet and a smartphone will probably be enough for most things. A good Internet connection everywhere is important, and I must trust the cloud provider. Encryption is key. I like this new world so far.

Paperless law practice

A few days ago, I talked to a Bay Street law firm partner whom I consider a mentor. During our chat, I passed him a document, but he returned it to me and asked for an electronic copy by email. He said he would scan my document and put it in the electronic document management system anyway. His “95% paperless” practice enjoys huge cost savings. The legal profession is conservative, but its most technologically advanced members already live the paperless reality.
